Terms and Conditions of Use
Welcome to ArthroCentre. By registering and using our services, you accept these terms and conditions.
1. Purpose
These terms govern the use of the digital platform and services offered by ArthroCentre.
2. Registration and Account
- Registration is available to persons aged 16 and over. Minors require authorisation from a legal guardian.
- You agree to provide accurate information and keep it up to date.
- You are responsible for maintaining the confidentiality of your account and password.
- You must notify us immediately of any unauthorised use of your account.
3. Memberships and Payments
- Membership types: We offer different plans with varying levels of access and credits.
- Renewal: Memberships renew automatically for periods equal to the one purchased, charging the plan's current price to the registered payment method. You can disable renewal at any time from your account; cancelling before the renewal date prevents the next charge.
- Payments: Payments are processed securely on the pages of authorised payment gateways (for example Stripe or PayPal). We do not store card numbers or bank details.
- Non-payment: In case of non-payment, we reserve the right to suspend access until the situation is resolved.
- Refunds: If you cancel your membership, the cancellation policy in force at the time of purchase applies. Where an immediate cancellation applies under that policy, the proportional part of the unused period will be refunded and the corresponding credit note issued. This is without prejudice to the rights consumer law grants you.
- Downgrades and balance in your favour: If you move to a cheaper plan part-way through a period you have already paid for, the unused portion is not refunded to your payment method: it stays as a balance in your favour at the payment provider and is applied automatically to your next invoices, which may come out lower or even at zero. No credit note is issued for that change, since no bank refund takes place and the membership remains active. If you later cancel, that is when the credit note is issued, covering the outstanding balance returned to you as well.
- Withdrawal: When purchasing a membership or service at a distance you have 14 calendar days to withdraw. If you ask for the service to start during that period, in case of withdrawal you will pay the proportional part of the service already provided.
- Temporary membership pause: Where enabled, you may temporarily pause your membership within the limits set by the centre (duration and number of pauses per period). During the pause, billing is suspended —without the renewal date advancing— and the credits of that membership become temporarily unusable, with their validity extended by the length of the pause. The pause is a courtesy of the centre and is not a transaction for consideration: it generates no invoice or tax document. The membership resumes at your request or automatically once the configured maximum duration is reached.
5. Credits and Booking System
- Credits: Credits included in your plan expire at the end of the current billing period, unless the plan's conditions state otherwise. One-time credit packs are added to your balance and are governed by the validity indicated at the time of purchase.
- Bookings: Bookings must be made in advance according to current policies.
- Booking cancellations: Booking cancellations must be made at least 48 hours in advance to recover credits.
- No-show: Failure to attend a booking will result in the loss of credits.
The detailed operation of the credit system (types, consumption priority, refunds and expiry) and the booking process is described in the User Guide, accessible from the "Help" section of the user dashboard.
6. Rules of use of the service
- Respect booking schedules and staff instructions.
- Follow the centre's rules and the guidelines applicable to each activity.
- Maintain a respectful attitude towards other users and staff.
- Inform staff of any condition relevant to the activity.
- Access under the influence of alcohol or prohibited substances is not permitted.
7. Liability
- Participation in activities and use of the service is at your own risk. Nothing in these terms excludes or limits our legal liability for wilful misconduct or negligence, or restricts the rights consumer law grants you.
- We are not responsible for personal belongings not kept in your custody.
- We are not liable for damages resulting from non-compliance with rules or instructions.
8. Intellectual Property
All content on the platform (texts, images, logos, software) is the property of ArthroCentre or its licensors and is protected by intellectual property rights.
9. Cancellation and Termination
- You may request cancellation at any time from your account or by contacting us.
- Cancellation takes effect according to the current cancellation policy.
- We reserve the right to cancel accounts for breach of these terms.
10. Modifications
We may modify these terms for justified reasons (legal, technical or operational). Substantial changes will be communicated individually at least 30 days in advance; if you do not accept them, you may cancel your membership before they take effect without penalty.
11. Applicable Law
These terms are governed by the law applicable in the country where the owner has its registered office. If you act as a consumer, this clause does not deprive you of the protection of mandatory rules or of the courts of your place of residence.
